It is not mandatory for MSC Malaysia Status Companies to have their office in MSC Malaysia Cybercities or Cybercentres. However, to enjoy the full benefits as a MSC status company, it is highly recommended that you house your office within MSC Cybercity or Cybercentre. These areas provide conducive and advanced telecommunication technologies and multimedia facilities. Currently, the Bill of Guarantee (BoG) 1 (world-class physical and information infrastructure) and BoG 8 (globally competitive telecommunications tariffs) are only applicable to MSC status companies which have their place of business in a Designated Premises within MSC Malaysia Cybercities or CybercCentres.

What is the meaning of “Designated Premises”?
“Designated Premises” are premises located within MSC Malaysia Cybercities or Cybercentres and are designated as such by the Malaysian Government. These designated MSC status building or Premises are required to fulfill a set of requirements in order to be assigned as “Designated Premises. A MSC status company with its place of business in “Designated Premises” is entitled to full benefits of the BoG. It is worth to note that not all commercial buildings within a MSC Cybercity or Cybercentre are “Designated Premises”. In fact, usually only a handful of them are “Designated Premises”. For e.g. in Bangsar South City, currently only 9 out of 22 blocks of office buildings are Designated Premises (the number may vary from time to time), while in the Mid Valley City, only The Gardens Tower is a Designated Premises.

What will happen if I decide not to have my office in Designated Premises?
If you opt to have your office within the non-Designated Premises in the MSC Malaysia Cybercities or Cybercentres, then you have to forego the benefits under BoG1 and BoG8.

Where do most MSC status companies have their office?

MSC status companies are spread over MSC status office and non-MSC status buildings. Your company location should be determined by your business objectives and needs. At this juncture, you may opt to have your office in the following MSC Malaysia Cybercities and Cybercentres:

Is it true that the rental or selling price for MSC status building is higher than other non-MSC status office?
Not necessary. I’m finalising the tenancy of a commercial MSC office space for lease. Meanwhile my partner is looking at a MSC office space available for sale. We would like to know how to compute the rental rate and purchase price of a MSC office on a per square foot (psf) basis?
It’s very simple. Assuming the office is of 2000 square feet and the rental rate is RM4 per square foot. The rental rate is RM8000 (RM4 x 2000 square feet). If the sale price per square foot is RM1000, then the total purchase price is RM2 million (RM1000 x 2000 square feet).

Are all MSC status office come with centralized air-conditioning system?
Not necessary. Some MSC status buildings are equipped with centralized air-conditioning system, while some are provided with individual/ split units air-conditioners. There are pros and cons for both systems. For centralized air-conditioning system, you only need to pay a fixed rental rate which has factored in the air-conditioning charges. While for individual air-conditioning system, apart from your rental rate, you have to be prepared to fork out an additional amount for air-conditioning charges which could be substantial if your company’s operations requires high power consumption. On the other hand, normally centralized air-conditioning is operated only during office hours from 8am to 6pm while with individually controlled air-conditioning systems, you are able to enjoy the air-conditioning at any hour depending on your need.

When I rent or buy an office, do I get a free carpark?
Generally commercial office is not leased or sold with carpark. In other words, you do not get complimentary carpark. Instead, you have to rent the carpark from the carpark management company. The parking expenses are normally borne by the tenant.

What about car park allocation? How many carpark will I be entitled to?
The common carpark allocation ratio is 1000sf of floor area will entitle you to 1 carpark. Additional parking lots may be available upon application and subject to the approval of the carpark management company. However, there may be exceptions where the ratio is 1:500sf or 1:1200sf etc.

I’m considering a MSC status corporate office space for lease. I would like to know who should pay the service charge or maintenance charges of the office?
Unless otherwise agreed by both parties, the property owner (i.e. landlord) will normally bear the service / maintenance charges.

What are the deposits required by the landlord in a tenancy?
Normally, the tenant is required to pay 1 month’s rental as earnest deposit or booking fees to secure the office. Thereafter, upon execution of the tenancy agreement, the tenant is required to place 2-3 months’ securities deposit and ½ to 1 month’s utilities deposit with the landlord. The requirements may vary on case to case basis and there may be other deposits required for example keys deposit, mailbox deposit, renovation deposit etc, as may be determined by the landlord or office building management.

Am I required to pay goods and services tax (GST) when I rent an office?
If your landlord is a GST registered entity, then yes, you are required to pay GST on top of the rental. Deposits are however not subjected to GST.

Besides the rental, what are the other costs and expenses which I need to bear every month during the term of tenancy?
Generally the tenant shall bear the utilities charges like water, electricity, internet service, telephone bills, sewerage and parking charges.

Can I rent a MSC status office for 1 year? Is there a minimum tenure which I must adhere to?
Normally the tenure of tenancy for office space is 2 years. However, there are cases where landlords accept a shorter term of tenancy of 1 year. If you are looking for tenancy shorter than 1 year e.g. 6 months, you may want to consider serviced office or virtual office which provides you the flexibility of having office for term as short as 1 month. I’m considering a MSC office to let in Kuala Lumpur. I would like to know who should bear the fees for preparation of tenancy agreement and its stamp duty?
Generally, unless both parties are represented by their own solicitors respectively, the tenant has to bear the fees for preparation of tenancy agreement. Stamp duty is to be paid by the tenant and it is computed based on a formula predetermined by the Inland Revenue Board.

I have entered into an agreement to rent an office space for rent in KL for 2 years. Can I terminate the tenancy before the expiry of the 2 years tenure?
You have to refer to the terms and conditions of tenancy agreement. Normally for tenancy of a fixed period, neither party can terminate the agreement before the expiry of the fixed period. Otherwise the defaulting party shall be liable to pay the innocent party compensation as agreed in the agreement.

Must I reinstate the office which I rent to its original condition upon the expiry of tenancy?
Almost all tenancy agreement has a standard term for the tenant to reinstate the office to its original condition upon expiry of tenancy. However, this may be varied by parties especially when the tenant’s renovation or fitting is acceptable to the landlord and the landlord agrees to waive the requirement of restoration.

Are all MSC status building a Grade A office space? What is a Grade A office specification?
Grade A office is not defined. Not all MSC status building is automatically a Grade A office space. One has to look at the office building’s location, its age, maintenance quality, facilities, security system, landlord credibility etc. to assess if the building is a Grade A office.
